1 Agreement to These Terms

These Terms of Service govern your access to and use of trypotenzia.com and any related webpages, content, features, communications, products, and services operated by POTENZIA LLC, doing business as Potenzia and trypotenzia.com (collectively, "Potenzia," "we," "us," or "our"). By visiting the website, creating an account, placing an order, or otherwise using our services, you agree to these Terms, our Privacy Policy, our Refund and Return Policy, and any additional terms presented at checkout.

If you do not agree, do not use the website or purchase our products. We may update these Terms by posting a revised version and updating the date above. Changes apply prospectively unless applicable law requires otherwise.

2 Eligibility and Intended Audience

You must be at least 18 years old and legally capable of entering into a binding agreement to use the website or purchase Potenzia products. By using the website, you represent that you meet these requirements. Our products are intended only for adults and must be kept away from children.

6 Prices Payments and Taxes

Prices are displayed in U.S. dollars unless otherwise stated and may change without notice. The price charged is the price shown at checkout when the order is submitted, subject to correction of obvious errors. Applicable shipping charges, taxes, duties, and other fees will be disclosed at checkout when practicable.

You authorize Potenzia and its payment processors to charge the payment method you provide for the total amount shown at checkout. You represent that you are authorized to use that payment method. We may correct pricing or typographical errors and cancel affected orders, including after an order confirmation has been sent.

7 Promotions Bundles and Gifts

Promotions, discount codes, bundles, gifts with purchase, and limited-time offers are subject to their stated conditions and may not be combined unless expressly permitted. We may modify or end a promotion at any time, but changes will not affect completed purchases except where correction is necessary for fraud or an obvious error. If a qualifying purchase is returned, the value of any promotional item not returned may be deducted from the refund where permitted by law.

8 Shipping Delivery and Risk

Delivery estimates are estimates only and are not guaranteed. Delays may occur because of carrier operations, weather, holidays, address issues, inventory, customs, or events outside our reasonable control. Customers are responsible for providing a complete and accurate delivery address and for monitoring tracking information.

Risk of loss and title pass as provided by applicable law and the selected carrier arrangement. Claims involving damaged, missing, misdelivered, refused, unclaimed, or returned packages are handled under our Refund and Return Policy. International customers are responsible for confirming that products may lawfully be imported and used in the destination country and for any duties, taxes, brokerage charges, or customs requirements, unless we expressly state otherwise.

9 Returns Refunds and Order Changes

Returns, refunds, replacements, cancellations, and address changes are governed by our Refund and Return Policy. That policy is incorporated into these Terms. Because our products include ingestible and personal-use items, opened or used products may be ineligible for return except when defective, damaged, incorrect, or otherwise required by law.

You are responsible for safeguarding your account credentials and for activity conducted through your account. Notify us promptly at info@trypotenzia.com if you suspect unauthorized access. We may suspend or terminate accounts used fraudulently, unlawfully, abusively, or in violation of these Terms.

If you submit feedback, suggestions, reviews, images, testimonials, or other content, you represent that you own or control the necessary rights and that the submission is accurate and lawful. You grant Potenzia a nonexclusive, worldwide, royalty-free, sublicensable license to use, reproduce, adapt, publish, translate, display, and distribute that content for operating, improving, and promoting Potenzia, subject to our Privacy Policy and applicable law. We may remove or decline content but are not obligated to monitor every submission.

Do not submit confidential information through reviews, public comments, or unsolicited ideas. Product reviews and testimonials reflect individual experiences and do not guarantee that another customer will obtain the same result.

13 Intellectual Property

The website and its text, graphics, logos, product names, trade dress, photographs, videos, software, and other content are owned by Potenzia or its licensors and are protected by applicable intellectual-property laws. Potenzia grants you a limited, revocable, nontransferable license to access and use the website for personal, lawful purposes. No other license or right is granted. By providing contact information, you consent to receive transactional communications concerning your account or orders. Marketing emails and text messages, if offered, are subject to separate consent and opt-out rights. Consent to marketing is not a condition of purchase.

TO THE FULLEST EXTENT PERMITTED BY LAW, THE WEBSITE, CONTENT, PRODUCTS, AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." POTENZIA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. POTENZIA DOES NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE OR THAT PRODUCT RESULTS WILL MEET YOUR EXPECTATIONS. SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY EXCLUSIONS, SO SOME EXCLUSIONS MAY NOT APPLY TO YOU.

17 Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, POTENZIA AND ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, SUPPLIERS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, LOSS OF PROFITS OR DATA, OR BUSINESS INTERRUPTION ARISING FROM OR RELATED TO THE WEBSITE, CONTENT, PRODUCTS, SERVICES, OR THESE TERMS, EVEN IF ADVISED THAT SUCH DAMAGES WERE POSSIBLE.

TO THE FULLEST EXTENT PERMITTED BY LAW, POTENZIA'S TOTAL LIABILITY FOR A CLAIM ARISING FROM A PRODUCT PURCHASE WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM. THESE LIMITATIONS DO NOT APPLY TO LIABILITY THAT CANNOT LAWFULLY BE LIMITED OR EXCLUDED, INCLUDING RIGHTS OR REMEDIES AVAILABLE UNDER APPLICABLE CONSUMER-PROTECTION LAW.

18 Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Potenzia and its members, managers, officers, employees, contractors, affiliates, suppliers, and service providers from third-party claims, liabilities, damages, judgments, losses, costs, and reasonable legal fees arising from your unlawful use of the website, your violation of these Terms, or your infringement of another person's rights.

19 Governing Law and Venue

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Unless applicable law requires otherwise, any judicial proceeding relating to these Terms, the website, or a purchase from Potenzia must be brought in the state or federal courts located in Lake County, Florida, and each party consents to their jurisdiction and venue.

20 Time Limit for Claims

To the extent permitted by law, a claim arising from or relating to the website, products, services, or these Terms must be filed within one year after the claim arose. This provision does not shorten a limitations period that applicable law does not permit the parties to shorten.

21 General Provisions

These Terms and the policies incorporated into them constitute the entire agreement between you and Potenzia concerning their subject matter. If a provision is held invalid or unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions will remain effective. Potenzia's failure to enforce a provision is not a waiver. You may not assign your rights or obligations without our consent. Potenzia may assign these Terms in connection with a merger, reorganization, sale of assets, or similar transaction.
